JACOB JONAS THE COMPANY X ATE9 INTENSIVE WAIVER

I am participating in any classes/workshops/physical practices offered by Jacob Jonas The Company (“JJTC”) and Ate9 Dance Company (“Ate9) and/or its affiliates/associates/artists and agree to the following.

I understand that there are risks of physical injury associated with, arising out of and inherent to the activity of dance/movement/yoga/physical exercise. In recognition of this acknowledged risk of injury, I knowingly and voluntarily waives all right and/ or causes of action of any kind, including any and all claims of negligence arising as a result of such activity from which liability could accrue to JJTC and/or Ate9.                                                  

I hereby agree to release JJTC and Ate9 and hold JJTC and Ate9 harmless of all liability, and hereby acknowledge that they knowingly and voluntarily assume full responsibility for all risks of physical injury arising out of active participation in dance/movement/yoga/physical exercise on behalf of myself. I am aware that this is a release of liability and an acknowledgement of my voluntary and knowing assumption of the risk of injury.

Any copyrightable works, ideas, discoveries, inventions, patents, products, or other information (collectively, the "Work Product") developed in whole or in part by me in connection with the creation and performance during the intensive shall be the exclusive property of the organization (either Jacob Jonas The Company or Ate9) hosting the specific intensive week in which I am participating.

I agree and covenant that I will not at any time make, publish, or communicate to any person or entity or in any public forum any defamatory or disparaging remarks, comments, or statements concerning JJTC and Ate9 or their businesses, or any of their employees, officers, directors, representatives, affiliates and existing and prospective customers, suppliers, investors, and other associated third parties in public or private forum.

I irrevocably grant JJTC and Ate9 and their sub-licensees, affiliates, assigns and designees, a non-exclusive, worldwide, perpetual, royalty-free rights and license to film, record, edit, use, modify, reproduce, distribute, display, exhibit and broadcast my likeness. I freely contribute for any inclusion to be used, published, and copied for use in any and all medium, including without limitation the World Wide Web (Internet), CD-ROM, DVD, successor delivery technologies, print and any other media, in such manner as The Company may determine in their sole discretion, including without limitation for advertising and promotional use (herein described as “content”) without payment, royalties or other consideration. I understand and agree that all content will become the property of Jacob Jonas The Company and Ate9.
